01About these terms

These Terms of Service ("Terms") apply to your use of the TIPSTA website at tipsta.au and every service on it (the "Service"). The Service is run by TIPSTA, an Australian business ("TIPSTA", "we", "us", "our").

By creating an account, ticking the box to agree at sign-up, agreeing at checkout, or otherwise using the Service, you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, please do not use the Service.

02What TIPSTA is

TIPSTA is a horse racing information service. Each race day we publish selections (such as Best Bet, Next Best and Value), a TIPSTA Price for runners, race analysis, results and our track record. These are produced by our own racing model and reviewed before publication.

• Everything on TIPSTA is general information and opinion for entertainment. It is not financial or betting advice and does not take your personal circumstances into account.
• TIPSTA is not a bookmaker or wagering service. We do not accept bets, place bets for you, hold your money or offer betting inducements.
• Odds and prices we show are indicative only. Bookmaker prices change and may be different when you bet.
• Selections can change before a race, for example after scratchings, track changes or late market moves. The version on the site at the time is the current one.
• Results and track record figures describe the past. They do not guarantee or predict future results.
• You are responsible for any decision to bet, and for following the laws where you live.

03Who can use TIPSTA

You must be at least 18 years old to create an account or use the Service. We ask for your date of birth at sign-up for this reason, and we may ask you to confirm your age at any time. We will close any account we reasonably believe belongs to someone under 18.

You must not use the Service if you are registered with BetStop (the National Self-Exclusion Register) or any state or territory self-exclusion scheme, or if betting on racing is unlawful where you are.

04Your account

• Give us accurate details when you sign up and keep them up to date.
• You must confirm your email address before your account is activated. We send you a verification link to do this.
• An account is for one person. Do not share your login or let anyone else use your membership.
• Keep your password private. You are responsible for activity on your account. Tell us straight away at tipsta.au@gmail.com if you think someone else has used it.

05Free accounts and memberships

Current plans and prices are below. Prices are in Australian dollars. The price shown to you at checkout is the price you pay.

Founding Member prices apply to eligible accounts and are shown at checkout. What is included in a free account may change over time.

You can also make an optional one-off payment to support TIPSTA. A support payment is voluntary and does not buy a membership or any extra access.

06Payments and renewals

• Payments are processed securely by Stripe. Your card details go directly to Stripe and are never stored by TIPSTA.
• Weekly, Monthly and Yearly memberships are charged in advance and renew automatically at the end of each period, using your saved payment method, until you cancel.
• Day Pass and Spring Carnival are single payments. They do not renew and you will not be charged again.
• If a renewal payment fails, your access may pause until payment is made.
• Promotion codes can be used at checkout where we offer them. Each code has its own conditions.
• If we change the price of a recurring plan, we will tell you by email before the new price applies to your membership. If you do not want to continue at the new price, you can cancel before your next renewal.

07Cancelling

You can cancel a Weekly, Monthly or Yearly membership at any time from your Membership page, or by emailing tipsta.au@gmail.com. Your membership stays active until the end of the period you have already paid for, and you will not be charged again.

Refunds are covered by our Refund Policy.

08Using TIPSTA fairly

The Service is for your own personal, non-commercial use. You must not:

• copy, republish, sell or redistribute our tips, prices, analysis or data, in full or in part, without our written permission;
• use bots, scrapers or other automated tools to access or collect content from the Service;
• get around the membership paywall, or share paid content with people who have not paid for it;
• interfere with, overload or try to break the security of the Service; or
• use the Service for anything unlawful, misleading or harmful.

We may suspend or close an account that breaks these Terms. Where that happens because of a serious breach, such as sharing or reselling access, fraud or misuse of payments, we do not have to refund the remaining period, except where the law requires it.

09Our content

All content on the Service, including tips, TIPSTA Prices, analysis, text, graphics, logos, the TIPSTA name and our software and models, belongs to TIPSTA or its licensors and is protected by law. Using the Service does not give you any ownership of it.

10Changes to the Service

We are always improving TIPSTA. We may add, change, pause or remove features, race coverage or content. Features marked "coming soon" are not yet available and may change before they launch.

We aim to keep the Service available, but we cannot promise it will always be uninterrupted or error free, for example during maintenance or when racing data from third parties is late or unavailable.

11Responsible gambling

We want betting to stay fun. Set a budget, never chase losses, and only bet what you can afford to lose. 12Your consumer rights and our liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms removes or limits those rights.

Apart from those rights, and to the extent the law allows:

• the Service is provided "as is", and we do not promise that any tip, price or piece of information is accurate, complete or will lead to a winning bet;
• we are not responsible for any betting losses, or for any decision you make based on the Service; and
• where our liability can be limited, it is limited to supplying the affected service again or refunding what you paid for the affected period.

13Other websites and services

The Service may link to, or rely on, other websites and services, such as bookmakers, racing information providers and Stripe for payments. We do not control them and are not responsible for their content, terms or privacy practices. Using them is at your own risk.

14Closing your account

You can ask us to close your account at any time by emailing tipsta.au@gmail.com. Cancel any active membership first so you are not charged again. What happens to your information after that is explained in our Privacy Policy.

15Changes to these Terms

We may update these Terms from time to time. The date at the top of this page shows when they last changed. If we make a change that materially affects paying members, we will let you know by email before it applies. Continuing to use the Service after a change means you accept the updated Terms.

16Governing law

These Terms are governed by the laws of Victoria, Australia. You and we agree to the jurisdiction of the courts of Victoria and the Commonwealth of Australia.
